Equitable Division of Marital Property
Minnesota law provides that marital property is to be "equitably" divided upon divorce. In most cases, "equitably" is interpreted as "equally." With this understanding, the complication comes from attempting to accurately value the parties' assets. Both parties may agree to split all marital assets in half. However, if the parties disagree on the assets' values, or on which assets are marital, disputes ensue.
