This effective alternative to traditional litigation offers a cooperative and often confidential way to participate in decisions that will impact your family.
Alternative Dispute Resolution Methods

Mediation
A confidential process in which Jane, as a neutral party, facilitates communication between the parties to promote settlement. This process is usually less expensive and less time consuming than going to trial.

Arbitration
A process in which Jane (rather than a judge) hears evidence and renders a legally binding decision resolving the parties’ disputes.

Moderated Settlement Conference
A late-stage settlement conference which Jane facilitates. It usually occurs just before the parties have a formal trial, and often at the courthouse. A Moderated Settlement Conference gives parties a final opportunity to settle their case and avoid the expense and uncertainty of a trial.

Consensual Special Magistrate (CSM)
This process is an alternative to trial by a judge or referee. To use a Consensual Special Magistrate, the parties must agree to use that process and the Court appoints the CSM. In this process, Jane serves in place of a judge, overseeing a motion or trial on the contested issues, and issuing a binding decision, which can be appealed to the Minnesota Court of Appeals.
